1. Acceptance of Terms

By accessing and using Budd ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and The International Psychology Clinic Limited (trading as Budd), a company registered in England and Wales under company number 10877544.

Budd provides an AI-powered mental health support platform offering:

• Science-backed therapy techniques including CBT, DBT, ACT, and Polyvagal approaches
• Guided exercises, journalling prompts, and behavioural activation planning
• Mood tracking and progress monitoring
• Homework assignments and therapeutic support
• AI-driven personalised recommendations

Important: Budd is NOT a substitute for professional mental health care. It is designed to complement, not replace, therapy with a qualified mental health professional. If you are experiencing a mental health crisis, please contact emergency services or a crisis helpline immediately.

3. User Eligibility

Budd is intended solely for users who are of legal age to form a binding contract in their jurisdiction. By accessing or using our services, you represent and warrant that you meet this requirement. We do not knowingly collect or maintain information from persons who do not meet this legal age. If we learn that we have collected personal information from such a person, we will delete that information as quickly as possible. If you believe that we might have any information from or about a person who does not meet this legal age requirement, please contact us immediately.

4. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use
• Ensuring your account information is accurate and up-to-date

Budd offers both free and premium subscription tiers:

• Free Plan: Limited to 50 messages per month, 20 starter exercises, access to core features
• Premium Plan: Unlimited messages, AI clinical reports, voice interaction, full exercise library (150+), advanced analytics

Premium subscriptions are billed monthly through Stripe. You can cancel at any time, and cancellation will take effect at the end of your current billing period. A 14-day money-back guarantee applies to new subscriptions. No refunds will be provided for partial months after the guarantee period.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code or attempt to harm the Service
• Impersonate another person or entity
• Use the Service to harass, abuse, or harm others
• Scrape, copy, or reproduce content without permission

7. Intellectual Property

All content, features, and functionality of Budd, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of The International Psychology Clinic Limited and protected by UK and international copyright, trademark, and other intellectual property laws.

Your therapy data (messages, journal entries, mood tracking) remains your property. By using the Service, you grant us a limited licence to use this data solely to provide and improve the Service.

8. AI and Automated Processing

Budd uses artificial intelligence and automated systems to:

• Provide therapeutic responses and recommendations
• Analyze patterns in your data to offer personalised insights
• Generate homework assignments and exercise suggestions

Whilst we strive for accuracy, AI systems may occasionally provide imperfect or inappropriate responses. You acknowledge that AI-generated content should not be considered professional medical advice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• That the Service will be uninterrupted, secure, or error-free
• That the results obtained from using the Service will be accurate or reliable
• That the Service will meet your mental health needs or expectations

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE INTERNATIONAL PSYCHOLOGY CLINIC LIMITED SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruption or data loss
• Any damages arising from your use or inability to use the Service

Our total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

11. Medical Disclaimer

Budd is a mental health support tool, NOT a medical device or professional therapy service:

• The Service does not provide medical advice, diagnosis, or treatment
• Always seek the advice of qualified health professionals for medical concerns
• Do not disregard professional medical advice because of information from Budd
• In case of emergency or crisis, contact emergency services immediately
• Budd is not liable for any health outcomes resulting from use of the Service

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees (for Premium accounts)

You may terminate your account at any time through the Settings page. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the app. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
